1. Program
Deer Designer LLC ("we") operates an affiliate program under which approved participants ("Affiliates") earn commissions on subscriptions purchased by customers they refer. Participation requires an application and our approval. We may decline any application without reason.
2. Links and codes
We provide a unique link and code. Affiliates may use them on their own websites, newsletters, social profiles, communities, podcasts, videos and direct communications. Affiliates may not use them on coupon, deal, cashback or voucher sites; in paid search advertising targeting Deer Designer trademarks or misspellings; in unsolicited bulk email; or in any domain, handle or business name containing "Deer Designer" or "BuckBoard".
3. Attribution
A customer is attributed to an Affiliate if the Affiliate's code is entered at checkout; otherwise if the Affiliate's link was the last affiliate or referral link clicked within 90 days before purchase; otherwise if the customer identifies the Affiliate within 30 days of purchase and we confirm it. For customers registered by the Affiliate through deal registration before any contact with us, attribution is protected for 90 days from registration regardless of the path to purchase. One attribution per customer. Our attribution decisions are final.
4. Excluded customers
The Affiliate's own business and any business they own or control; customers with an existing or prior Deer Designer subscription within the last 6 months; customers with a sales conversation with us that began more than 30 days before attribution.
5. Commission
20% of each invoice amount actually paid by an attributed customer, net of credits, discounts, refunds and taxes, for 12 months from the customer's first paid invoice. When an Affiliate has five or more attributed customers with active subscriptions at the same time, the rate on commissions created thereafter is 25%, reverting to 20% from the first day of the month after the count falls below five. Commissions on the first invoice are released only once the second invoice is paid (annual plans: 60 days after first payment). No commission accrues after 12 months, on pause periods, or on invoices unpaid.
6. Customer incentive
Attributed customers receive a $500 credit on their second monthly invoice (or $500 off an annual invoice). Affiliates may promote this incentive and may not offer any other discount, rebate or incentive on our services.
7. Hold and payment
Each commission is held for 30 days after the underlying invoice is paid. Cleared commissions are paid monthly, by the 15th, for amounts cleared by the last day of the prior month, when the balance is at least $100 USD; smaller balances roll forward. Payment is by Wise or, for US Affiliates on request, ACH. We do not pay by PayPal. Affiliates must provide accurate payout details and a completed IRS Form W-9 (US persons) or W-8BEN / W-8BEN-E (non-US persons) before the first payment. Affiliates are responsible for their own taxes. We will issue Form 1099-NEC to US Affiliates as required.
8. Refunds, chargebacks and clawback
Commissions on refunded or charged-back invoices are void. Where already paid, the amount is deducted from future commissions or, if none accrue within 90 days, is repayable on request.
9. Conduct and claims
Affiliates must clearly disclose their affiliate relationship wherever they promote us, in accordance with FTC guidance and any local equivalent. Affiliates may only make claims listed in the current affiliate kit. In particular, Affiliates may not describe our services as "unlimited", state turnaround times in hours, offer guarantees, use urgency or scarcity tactics (including countdown timers or "limited spots"), or make claims about competitors beyond those in the kit. Affiliates may not represent themselves as employees or agents of Deer Designer, sign anything on our behalf, or handle customer payments.
10. Brand
We grant a limited, revocable, non-exclusive licence to use our name, logo and approved assets solely to promote the program under these terms. All rights remain ours.
11. Relationship
Affiliates are independent contractors. Nothing creates employment, partnership, joint venture or agency.
12. Term and termination
Either party may end participation on 30 days' written notice. Cleared and held commissions at termination are paid on the normal schedule; no further commissions accrue after the termination date. We may terminate immediately for breach of sections 2, 4, 6 or 9, in which case unpaid commissions are forfeited. On termination, Affiliates must stop using our links, codes and assets within 5 days; portal access becomes read-only for 90 days.
13. Program changes
We may change commission rates, terms or the program with 30 days' notice by email and on this page. Changes do not apply retroactively to customers attributed before the change.
14. Data
Affiliates see the company name, plan and status of attributed customers, and nothing else. Affiliates may not contact attributed customers about their Deer Designer account on our behalf. We process Affiliate data under our privacy policy.
15. Liability
Our total liability under the program is limited to commissions properly due and unpaid. We are not liable for indirect losses, or for losses from tracking failures beyond our reasonable control, provided we act in good faith to resolve attribution disputes raised within 30 days.
16. General
These terms, the Deer Designer Terms of Service and Privacy Policy form the whole agreement. Governing law and venue: as in the Terms of Service. If any part is unenforceable, the rest stands. Our records are conclusive absent manifest error.
