Premium Stock Assets
Terms and Conditions
1. Definitions
1.1. Deer Designer: refers to the entity providing design services to clients.
1.2. Client: Refers to the individual or entity engaging Deer Designer’s services for design projects.
1.3. Items: refers to the Premium Stock Assets acquired by Deer Designer through its subscription provided by Envato Elements or any other premium stock provider.
1.4. End Product: refers to the designs created using the said items.
2. License and Usage
2.1. Deer Designer holds a subscription with Envato Elements, granting access to Items (premium stock assets).
2.2. For each project, the Client is granted a limited, non-exclusive, non-transferable license to use the **Items** (premium stock assets) as incorporated within the End Product, which refers to the final design created by Deer Designer using those Items.
2.3. The license permits the Client to utilize the End Product for both personal and commercial purposes, subject to the restrictions outlined in Section 4.
3. Permitted Uses
3.1. The Client may use the Items (premium stock assets) solely as part of the finalized End Product delivered by Deer Designer.
3.2. The Client is prohibited from using the Items for any purposes outside the scope of the final design project without prior written consent from Deer Designer.
4. Restrictions
4.1. The Client may not sublicense, sell, distribute, or otherwise transfer the Items or the rights granted herein to any third party without explicit written permission from Deer Designer.
4.2. Modifications or alterations to the Items by the Client are prohibited unless carried out by Deer Designer as part of the design process
5. Ownership and Attribution
5.1. The ownership of the premium stock assets remains with the original copyright holder (Envato Elements or the respective stock provider).
5.2. The Client agrees not to claim ownership or authorship of the premium stock assets used within the final design project.
5.3. Attribution requirements specified by Envato Elements or the respective stock provider must be adhered to by the Client where applicable.
6. Indemnification
6.1. The Client agrees to indemnify and hold harmless Deer Designer from any liabilities, damages, or expenses arising out of or related to the Client’s use of the premium stock assets beyond the agreed-upon scope.
7. Termination
7.1. In the event of termination or expiration of the agreement between Deer Designer and the Client, the Client’s right to use the items (premium stock assets) also terminates.
